Unterlassungsaufforderung: Anthem & IMPACT Wrestling drohen Hardys mit Klage wegen Nutzung der „Broken“-Namensrechte

Wie PWInsider & NoDQ berichten, hat die gesamte Hardy-Familie (Matt Hardy, Jeff Hardy, Reby Hardy, King Maxel & Señor Benjamin) am Freitag, den 10. März 2017 eine dreiseitige Unterlassungsaufforderung von Anthem Sports And Entertainment erhalten, in der die gesamte Familie dazu aufgefordert wird, die weitere Nutzung der „Broken“-Charaktere und alles was damit zusammenhängt, zu unterlassen, da sie die gesamte Hardy-Family ansonsten verklagen werden. In der besagten Unterlassungsaufforderung weist Anthem darauf hin, dass der „Broken“-Charakter und alles was damit zusammenhängt, geistiges Eigentum von Anthem bzw. IMPACT Wrestling ist, da das besagte Gimmick entstanden ist, als die Hardys noch unter Vertrag bei IMPACT Wrestling waren.

Ed Nordholm, Executive Vice President, Anthem Sports & Entertainment, President of Liberty Street Capital Corporation, welcher als knallharter Geschäftsmann gilt, hat folgende Nachrichten via Twitter gepostet – wenige Stunden bevor die Hardys die besagte Unterlassungserklärung erhalten haben:

Die Unterlassungsaufforderung sorgte umgehend dafür, dass Reby Hardy, die Ehefrau von Matt Hardy, ihrem Ärger auf Twitter freien Lauf ließ und kein Blatt vor dem Mund nahm, da Anthem vor allem ihren Vater Señor Benjamin mit in die Sache hereingezogen hat, welcher nie unter IMPACT Wrestling-Vertrag stand. Reby Hardy feuerte wie folgt gegen Anthem und IMPACT Wrestling zurück (zensierte Version):

Oh & this the best part…these MFers trying to come after SEÑOR BENJAMIN.   „Señor Benjamin“ – my dad, by the way – who was never paid a dime by the company & who was obviously never under contract……Not that those contract things mean anything to TNA…Until after they’re over or until 3 days before they expire, apparently.

Good luck explaining to your talent that their pay checks are late (again) because you’re spending all your $$ suing the Hardys.

Weiter berichtet Mike Johnson vom PWInsider, dass neben den Hardys auch Ring Of Honor sowie diverse „PPV Distributors“ eine Unterlassungsaufforderung bezüglich der „Broken Hardys“ erhalten haben, was letztendlich dazu geführt hat, dass Matt & Jeff Hardy am Freitag, den 10. März 2017 beim ROH „15th Anniversary“ Pay-Per-View nicht als The Broken Hardys („Broken“ Matt Hardy & „Brother Nero“ Jeff Hardy), sondern lediglich als The Hardys (Matt & Jeff Hardy) aufgetreten sind.

Wie bereits an anderer Stelle berichtet, hat Matt Hardy laut Informationen von Pro Wrestling Sheet am 01. März 2017 versucht, sich den Namen „Broken Matt Hardy“ für die Nutzung in der Unterhaltungsindustrie und im Wrestling-Business rechtlich schützen zu lassen und den entsprechenden Antrag beim „United States Patent and Trademark Office“ eingereicht. Da dieser Antrag von Matt Hardy bislang noch nicht genehmigt worden ist, scheint sich mittlerweile auch Anthem / IMPACT Wrestling in dieser Sache eingeschaltet zu haben.

Es bleibt abzuwarten, welche der beiden Seiten sich am Ende bezüglich der Namensrechte am „Broken“-Charakter durchsetzen wird: Matt Hardy oder Anthem / IMPACT Wrestling.
